Could It Be Unethical Not To Use AI?

The American Bar Association (ABA) has passed Resolution No. 112, which urges lawyers and courts to address the ethical and legal issues related to the use of artificial intelligence (AI) in law practice. The resolution highlights the importance of addressing issues such as explainability, bias, and transparency of automated decisions made by AI, ethical usage of AI, and oversight and control of AI and its vendors. The ABA’s resolution also raises the question of whether it is unethical not to use AI. AI technology is becoming increasingly common in the everyday practice of law and shapes the duty of competent representation in at least three ways.
