The legal profession’s initial resistance to technology, particularly generative AI, has shifted to recognising the need for its ethical adoption. Bar associations, particularly in Texas, have provided timely ethics guidance through reports and opinions to address moral concerns related to generative AI use in law.
The Texas Professional Ethics Committee’s Opinion 705 highlights key ethical issues. It emphasises the necessity for lawyers to understand the technology, assess associated risks (like inaccuracies and data security), and protect client confidentiality. The Committee outlines a roadmap for adopting AI, which includes understanding the technology, reviewing terms of service, evaluating data security measures, and training staff.
Additionally, it states that generative AI fees can be charged to clients with consent, but lawyers cannot charge for efficiency gains from using qAI. The focus now is on responsible and informed implementation of AI in legal practice.
