Florida Bar Ethics Opinion OKs Lawyers’ Use Of Generative AI, But With Cautions

The Florida Bar has issued an ethics advisory opinion stating that lawyers can use generative artificial intelligence (AI) technology but must comply with their ethical obligations. The opinion recommends lawyers continue to develop their competency in the use of new technologies, such as AI, and the risks and benefits they present. The opinion cautions lawyers using generative AI to protect the confidentiality of client information, develop policies for generative AI use, ensure fees are reasonable, and comply with applicable ethics and advertising regulations. Lawyers must also review the work product of generative AI, just as they would with nonlawyer assistants. Finally, the opinion warns against using generative AI in ways that might constitute the practice of law.
