Delaware Supreme Court allows limited use of AI for judges and court staff under new policy

The Delaware Supreme Court has introduced a temporary policy allowing judges and court personnel to use artificial intelligence (AI) with specific restrictions to ensure responsible application. Key points include:

Judicial officers must exercise caution and maintain accountability for their work when using generative AI tools, which require prior approval from the court’s administrative office.

Users must complete training before using these tools and cannot transfer decision-making to AI.

The policy, supported by the Delaware Commission on Law and Technology, aims to balance the benefits and risks of generative AI while protecting sensitive information.

Users must not enter confidential data into unauthorised AI and cannot use unapproved AI on state resources.

This move aligns with increasing interest in AI within the legal sector, similar to initiatives by other courts like the Georgia Supreme Court, which also explores AI’s impact on the judiciary.
