Federal Judge Rules Legal Research Startup ROSS Infringed Westlaw’s Copyrights, Rejecting Fair Use Defense

A federal judge ruled in favor of Thomson Reuters in its copyright infringement case against ROSS Intelligence, determining that ROSS had violated Westlaw’s copyrighted headnotes while developing its AI-driven legal research tool. The judge dismissed ROSS’s fair use argument and acknowledged a previous error in his rulings. Although significant issues remain for trial, including the potential lapse of Thomson Reuters’s copyrights and whether ROSS replicated Westlaw’s Key Number System, the ruling emphasized the fair use factors and originality of the headnotes. ROSS halted its operations in 2021 due to the lawsuit’s financial strain, and this ruling has implications for AI companies using copyrighted content, especially in competitive contexts.
