Exploring AI in criminal justice: What Malaysia can teach us

Advancements in artificial intelligence (AI) are significantly impacting the criminal justice system, with Malaysia becoming a focal point for examining the intersection of technology and justice. The country has launched AI-driven sentencing tools, such as the Artificial Intelligence Sentencing System (AISS), initially in Sabah and Sarawak, and is gradually implementing them across Peninsular Malaysia. 

The integration of AI aims to assist human judgment in sentencing, promoting consistent and equitable outcomes. Professor Azrini Wahidin’s discussion raises concerns about the potential widening of the digital divide in international criminal justice practices if nations do not adopt AI technologies highlighting the need to understand how those in the criminal justice system—judges and magistrates—perceive the use of AI, as their insights are crucial for policy development.

The initiative aligns with Malaysia’s broader digital governance goals, including the establishment of a national artificial intelligence office in 2024 to facilitate AI integration. Ultimately, the research seeks to provide recommendations for balancing innovation with ethical considerations in criminal justice and emphasizes the importance of evaluating AI’s role in legal decisions worldwide.
