DHS Ordered OpenAI To Share User Data In First Known Warrant For ChatGPT Prompts

Over the past year, U.S. federal agents investigating a dark-web child exploitation site made little progress—until a break came from the suspect’s use of ChatGPT.

According to an unsealed search warrant obtained by Forbes, Homeland Security Investigations (HSI) had been communicating undercover with the site’s administrator, who mentioned using ChatGPT and shared some of his prompts, including a lighthearted one about “Sherlock Holmes meeting Q from Star Trek.” Another involved ChatGPT generating a humorous, Trump-style poem about the Village People’s “Y.M.C.A.” Investigators later sought a court order requiring OpenAI to hand over identifying data—such as account information, linked names, addresses, and payment records—connected to those prompts. This marked the first publicly known instance of U.S. authorities requesting user data from a generative AI company.

In the end, agents didn’t need OpenAI’s data to identify the suspect. Through continued undercover chats, they learned he was affiliated with the U.S. military and had lived in Germany for several years. Investigators eventually alleged that 36-year-old Drew Hoehner, formerly stationed at Ramstein Air Force Base, was behind the site and charged him with conspiracy to advertise child sexual abuse material (CSAM). HSI, part of ICE, had pursued the case since 2019, linking the suspect to about 15 dark-web CSAM sites with over 300,000 users, including one section dedicated to AI-generated material.

It remains unclear what information OpenAI ultimately provided; a sealed file shows agents received one spreadsheet. While the prompts themselves were harmless, the case highlights how ChatGPT and other AI tools can become sources of evidence in criminal probes. OpenAI has reported tens of thousands of CSAM-related incidents to authorities and has faced dozens of government data-disclosure requests. Privacy advocates, including the Electronic Frontier Foundation, warn that the case underscores the need for AI companies to minimise data collection and protect user privacy as law enforcement increasingly turns to generative-AI platforms for digital evidence.
